Rulemaking
The State Legislature can delegate authority to state agencies to create rules that help the agency perform its duties. Rules guide agency practices and can be adopted through formal, exempt or expedited rulemaking, depending on which process the legislature wants the agency to use. The particular language that includes this mandate is called the statutory authority for the rule. View the Legislature's list of Minnesota Rules organized numerically by chapter. Rulemaking Docket
The Minnesota Department of Education is responsible for maintaining a public docket for each rule currently under consideration. The docket lists the subject matter of each rule, the current status, the agency contact person, and links to any relevant documents. Those items are listed below.
Science Academic Standards Rules
The Minnesota Department of Education is moving forward in the rulemaking process for the science academic standards rules. The Dual Notice will be published in the State Register on January 19, 2010. The Dual Notice document explains that the agency will adopt the proposed science academic standards rules unless it receives 25 or more requests for a hearing. Instructions on how to request a hearing or submit a comment are included in the Dual Notice document. A copy of this Dual Notice, the proposed rule language for the science academic standards, and the SONAR are posted below. PLEASE NOTE: The Minnesota Department of Education has recieved several comments about and requests for a hearing related to language included in the 2004 Science Benchmarks. The science benchmarks are not included in the proposed science academic standards rule language. The science benchmarks and the proposed science academic standards rules are separate works and language from the science benchmarks is not included in the proposed rule language. Hearing requests submitted in response to language in the science benchmarks are not valid. Minnesota Rule 1400.2080 requires that a person requesting a hearing identify the portion of the rule to which the person objects or must state that the person objects to the entire rule. In order to submit a valid hearing request please submit a hearing request related to language in the proposed science academic standards rules in accordance with the directions set out in the Dual Notice published January 19, 2010, in the State Register. A copy of the Dual Notice and the proposed science academic standards rules are posted below.
Arts Academic Standards Proposed Rule Amendments
The rulemaking process for these proposed rules is now complete, and the Minnesota Department of Education has formally adopted new rules governing arts academic standards. The new rules are numbered 3501.0800 to 3501.0815. Access a copy of the new rules at the Revisor's Website.
Supplemental Educational Services Providers Rules
The Minnesota Department of Education is using the expedited rulemaking process to revise its rules governing supplemental educational services providers, Minnesota Rules Chapter 3512.5400, to include evaluation, monitoring and complaint procedures for supplemental educational services providers. A copy of the proposed rules is available below on this webpage, along with the Notice of Intent to Adopt Expedited Rules. Comments on the proposed rules must be received by 4:30 p.m. on February 27, 2009.
Graduation-Required Assessment for Diploma (GRAD) Proposed Rules
The rulemaking process for these proposed rules is now complete, and the Minnesota Department of Education has formally adopted new rules governing the Graduation-Required Assessment for Diploma (GRAD). The new rules are numbered 3501.1000 to 3501.1190. The new rules are available below, or view the rules on the Revisor's Website.
Secondary Career and Technical Education Rules
The rulemaking process for these proposed rules is now complete, and the Minnesota Department of Education has formally adopted new rules governing Secondary Career and Technical Education. The new rules are numbered 3505.1000 to 3501.5900. The new rules are available below, or view the rules on the Revisor's Website.
